Deng Law Center

Escalator and Elevator Malfunctions: The High Standard of Common Carrier Liability
When an elevator drops suddenly, mislevels with the floor, or an escalator step collapses, building owners often try to deflect blame. They point to third-party maintenance contractors or argue that mechanical failures are "unforeseen accidents." At Deng Law Center, led by community advocate Daniel Deng, we provide a Fearless Defense against these corporate excuses.
A common piece of misinformation is that a building owner is only liable if they had prior warning of a breakdown. In 2026, California tort law rejects this excuse. Under state law, operating an elevator or escalator automatically elevates a property owner to a Common Carrier, imposing the highest duty of care known to the legal system.
The Common Carrier Classification: Civil Code § 2100
Many property owners are shocked to learn that in the eyes of California law, their vertical transportation makes them no different than a commercial airline, taxi, or train service. Under California Civil Code Section 2100, any entity that carries persons for reward must use the "utmost care and diligence" for their safe carriage.
Dating back to the landmark California Supreme Court ruling in Treadwell v. Whittier, the judiciary established that passengers inside an elevator are entirely helpless and without the means of self-protection upon the breaking down of machinery. Therefore, the law throws its heaviest protection around them.
Shifting the Burden: Res Ipsa Loquitur
Because of this heightened standard, victims of sudden mechanical failures do not always face the grueling burden of proving exactly which bolt or wire snapped. Instead, our firm frequently utilizes the evidentiary doctrine of Res Ipsa Loquitur ("the thing speaks for itself").
Under this framework, a presumption of negligence is unlocked if we demonstrate:
- The accident is of a kind that does not ordinarily occur unless someone was negligent.
- The elevator or escalator was under the exclusive control of the building owner or their maintenance provider.
- The injury was not due to any voluntary action or contribution by the victim.
Once established, the burden shifts to the building owner to prove they were not negligent—a remarkably difficult task when a machine fails.
The Non-Delegable Duty Trap
Another frequent corporate tactic is the "Contractor Shield." Owners will argue, "We hired a certified maintenance company, so talk to them." California law strictly prohibits this defense. Property owners owe a non-delegable duty to their passengers. While you can sue the maintenance company for negligent repairs, the building owner remains independently and directly liable for the safety of the ride. They cannot contract away their legal responsibility.
